Condominiums and Home Owners Associations

The firm represents approximately 35 residential and commercial condominiums and homeowner associations, ranging in size from a 12 units to more than of 450 units.  We work with self-managed associations as well as in cooperation with management companies.  We also work with developers in the creation and development of community associations as well as individual homeowners.  We serve as both general counsel to associations and as special counsel for specific projects, such as transfer of control situations, easement disputes, construction litigation, updating governing documents or contract review. 

We have found that our experience in representing municipalities, local banks and real estate developers provides real benefits in providing practical and effective guidance and recommendations to community associations.  We have represented developers in the development and transfer of control of associations as well as municipal clients with respect to development and dedication issues.  We have substantial litigation capacity and have been involved in a number of construction litigation cases involving associations. 

Among other services, we can provide support and guidance in:

  • Drafting and updating declarations, bylaws and rules and regulations.
  • Enforcing declaration and rules violations.
  • Providing contract drafting, review and negotiations for service and material vendors (including security systems, lawn care, pool service, software systems, among others).
  • Providing contract review and negotiations for capital improvement and replacement projects.
  • Providing review of loan documentation for financing.
  • Litigation, including construction claims, breach of contract and personal injury claims.
  • Providing guidance on regulatory, liability and employment matters.
  • Providing guidance on FCC satellite dish regulations and related matters.
  • Providing guidance on elections, director’s responsibilities and fiduciary duties and related matters.
  • Providing guidance and drafting documents pertaining to declarant transfer of control.
