As we discussed in our July Client Alert, The Economic Growth and Tax Relief Reconciliation Act of 2001 made significant changes in several areas of the Internal Revenue Code (the “Code”), many of which are set to expire at the end of 2010 unless Congress acts to extend them. However, as the end of 2010 approaches we believe that it is unlikely that Congress will act before the end of the year and even if it does, making any changes retroactively would face legitimate constitutional challenges. The current economic outlook, historically low interest rates and tax rates set to automatically rise in the near future are all factors which present taxpayers with a golden opportunity to plan gifting strategies that take advantage of the federal tax laws as they stand today.
